Equitable Distribution

Equitable distribution refers to the court-ordered or agreed-upon division of marital and divisible property associated with a divorce. Equitable distribution is one of the more complex areas of family law. It involves identifying, valuing, classifying and distributing the net marital and divisible estate equitably between the parties. It is important to remember that equitable does not mean equal; it means fair. While there is a presumption that the marital estate should be divided equally, there are factors for a judge to consider in making an unequal distribution of the marital estate.

As one of Asheville’s premier family law firms, we routinely represent clients who have separate property interests. In some cases, we may need to engage an expert consultant to assist in identifying and tracing separate property. Through many years of practice, we have developed a reliable network of appraisers, accountants, and valuation experts who are available to assist when needed.

With a primary focus on family law, the attorneys at Siemens Family Law Group are experienced in skillfully handling all aspects of the equitable distribution process, and all sizes of estates, including high net worth estates. Regardless of the size or complexity of your estate, our attention to detail, innovative solutions, and strategic representation can make a positive difference in the outcome of your equitable distribution case.
